THESE T&C, TOGETHER WITH THE PRIVACY POLICY AVAILABLE AT ROSTUDY.COM CONSTITUTE THE TERMS OF YOUR ACCESS TO AND USAGE OF THE WEBSITE. BY ACCESSING OR USING OUR WEBSITE, YOU AGREE TO COMPLY WITH AND BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS (“T&C”), PRIVACY POLICY AND OTHER APPLICABLE POLICIES.

2. Overview of Rostudy and Services thereof

Rostudy is an online 'intermediary' platform that connects students with coaching classes. As a service, We merely facilitate the discovery and booking of coaching services but do not directly provide the classes. All coaching services are delivered by third-party providers who operate independently from Us. We make no warranties or representations or assume any liability regarding the quality, effectiveness, or suitability of the services provided by the coaching providers listed on Rostudy.

The Rostudy is accessible to visitors / non-registered Users and registered Users. "Registered Users" are Users who have registered themselves an account on the Website by providing with certain information and who can log on to the Website by providing their Username and password. "Non-Registered Users" are Users who are not registered with the Website but may access information on the Website. Certain features of the Website are available to Registered Users only.

Rostudy’s features and services being offered:

For Registered Users:

• Platform for Booking Coaching Services: Registered Users may utilize the Website to book coaching services offered by listed service providers by paying a one-time booking amount.
• Trial Period for Coaching Services: Upon booking, Users are entitled to a trial period of ten (10) days during which they can evaluate the quality and effectiveness of the coaching services provided by the selected coaching provider (“Trial Period”).
• Right to Cancel During Trial Period: If, within the 10-day trial period, the User is not satisfied with the coaching services, they have the right to cancel the booking and may raise a formal request for a refund of the booking amount as per the rules of refund as may be applicable.

For Visitors/Non-Registered Users:

• Access to Coaching Provider Profiles: Non-registered Users may access the profiles of coaching providers listed on the Website.
• Access to Coaching Provider Availability: Based on the information provided by coaching providers, the Website displays the indicative availability for booking coaching services.

3. Eligibility for Uses

By accessing or Using Rostudy, You represent and warrant that:

• You are at least 18 years of age, or have obtained the consent of a legal guardian to Use the services and that Your use of the Website shall not violate any applicable law or regulation.
• You will provide true, accurate, current, and complete information when creating an account on our platform.

4. User Responsibilities

You are solely responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account. You agree to Use the Website for lawful purposes only and refrain from any misUse that could harm the Rostudy or Company or other Users.

5. Coaching Services and Payments

The User acknowledge and understand that:

• All coaching services offered on the Rostudy are provided by third-party coaching providers, and the Rostudy is merely an 'intermediary'. We shall neither be held liable nor assume any liability regarding the quality, effectiveness, or suitability of the services provided by the coaching providers listed on Rostudy.
• The Company or Rostudy shall have no liability whatsoever after the Trial Period ends and the User continues to avail the coaching services from the service providers listed on the Website.
• The booking, cancellation, and refund subsequent to the lapse of the Trial Period are governed solely by the respective coaching providers and their policies.

6. Intellectual Property Rights

All materials and content displayed on the Rostudy Website, including text, graphics, logos, and software, are the exclusive property of Ros Education And Startup Pvt Ltd. Any unauthorized reproduction, modification, or distribution of any content from the Website is strictly prohibited unless prior written consent has been obtained from the Company.

7. Limitation of Liability

While We strive to provide a seamless experience to You, notwithstanding anything, We do not guarantee or make representations or warranties that the Website will be error-free or uninterrupted. We do not warrant that the Website will be free of errors, viruses, or other harmful components. We shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from Your Use of, or inability to Use, the Website or the services provided therein. The services on the Website are provided strictly on an “as is” and “as available” basis.

Subject to the terms of this T&C, we make no guarantees, representations, or warranties, whether expressed or implied, with respect to the quality, effectiveness, or suitability of the services provided by the coaching providers listed on Rostudy. To the fullest extent permitted by law, we shall not be responsible for any default or wrongful acts, omissions, breach of service, or service deficiency by such service providers.

8. Termination

The Company reserves the right, in its sole discretion, to terminate or suspend Your access to the Website at any time, without notice, if it is determined that You have violated these T&C or are engaged in activities that are unlawful or harmful to the Company or its Users.

9. Governing Law and Dispute Resolution

The interpretation of this T&C and the resolution of any disputes arising under this Agreement shall be governed by the laws of India.

Any disputes arising out of or in connection with Your Use of Rostudy, including disputes relating to the interpretation or enforcement of these T&C, shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding shall be brought exclusively before the courts located in Chhattisgarh, India, and You hereby submit to the jurisdiction of such courts.

10. General Provisions

Severability: If any provision of this T&C is held by a court or forum of competent jurisdiction to be unenforceable under applicable law, then such provision shall be excluded from the Agreement, and the remainder of the T&C shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms. Provided however that, in such an event, the T&C shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court or forum of competent jurisdiction.

Complete Understanding: This T&C contains the entire understanding of the Parties, and there are no other written or oral understandings or promises between Rostudy or Company and the User with respect to the subject matter herein.

Assignment: No assignment of the rights, duties, or obligations under this Agreement, in whole or in part, to any person or entity shall be permissible and binding without the prior written consent of the Company.

11. Changes to the Terms

The Company reserves the right to amend or modify these T&C at any time. Such modifications shall become effective upon being posted on the Website. Your continued Use of Rostudy following the posting of any amendments will constitute Your acknowledgment and acceptance of the modified T&C.
